Naivas and Choppies angling to replace Nakumatt at Nyali (Kenya)

Retailers Naivas and Choppies are seeking to replace Nakumatt Holdings at Nyali Plaza in Mombasa where their troubled rival is currently running its business under the brand name Nakumatt Cinemax.

Nyali Plaza Limited, the landlord, reveals in court documents that Naivas and Botswana-based Choppies have each expressed interest to occupy the premises as anchor tenant.

Nyali has filed an application at the High Court seeking to evict Nakumatt over unpaid rent estimated to be standing at Sh12 million.

“I can confirm that there are two well established supermarkets namely Naivas and Choppies, who have expressed keen interest in taking over these premises in an anchor tenant capacity,” Dhiresh Shah, director Nyali Plaza Limited says in the court document.

The firm says it served Nakumatt with demand to clear Sh7.7 million rent arrears in November.  It says the arrears has since risen to Sh12.7 million since the advance first quarter rent of the year is now due.

The application to evict the retailer from Nyali Plaza has been filed in a case pitting the supermarket against scores of creditors including landlords.

Nakumatt is currently seeking the appointment of an administrator to run its affairs until it gets back on its feet.

The supermarket on Thursday asked for adjournment of the hearing of the case on the grounds that it is in the process of securing guarantors for the landlords.

It is expected to submit to court details of the guarantors, with hope that creditors and landlords will by consent allow the administrators to take over the business as a part of its recovery plan.
